As a result of operational-investigative measures taken, alleged illegalities were revealed during the realization of the operational information received in the CBI of the Military Police of the RA Ministry of Defence. On 12.11.2020 A.A., the daughter of citizen K.A., submitted an application to the Commission of "Prisoners of war, missing servicemen and other persons in the course of hostilities", in which she stated that her father, who, according to her, participated in 44 -day war, left home and no longer any information was received about him. Based on the application, K.A. was included in the list of missing servicemen and volunteers.

On 30.07.2021 A.A. appealed to the Court of General Jurisdiction of the of First Instance of Kotayk Region /Court Case K/D8867/02/21/ with a request to recognize K.A. as missing person. She stated in court that her father voluntarily participated in the 44-day war of 2020 and she has had no information about him for a long time.

According to the decision of the same court dated 22.11.2021, K.A. was recognized as missing and according to the law "On compensation for damages caused to the life or health of servicemen during the defence of the Republic of Armenia", K.A.'s daughters, A.A. . and A.A., were recognized as beneficiariesand and each was paid 5,000,000 AMD as a lump sum and 500,000 AMD as a monthly payment for the period March-June 2022, a total of 11,000,000 AMD.

As a result of the operative-intelligence measures taken by the employees of the CBI of the Military Police of the Ministry of Defence, it was found that K.A. was not conscripted, did not volunteer and did not die during the 44-day war of 2020. K.A. was found in the Martakert region of the Republic of Artsakh and clarified that back in July 2019 he informed his daughters that he was leaving for permanent residence in the Hovtashen community of Artsakh. KHA also stated that he did not participate in the 44-day war.

Considering that the actions of A.A., A.A. and officials of the Ministry of Defence appear to have the features of the crime provided for by Articles 255 (fraud) and 550 (military official negligence) of the RA Criminal Code, relevant documents were sent to the Military Investigative General Department of the Republic of Armenia to determine the further course of actions.
